I think your character just does the 'pick up' animation even though the item stays on the ground, that usually happens when you're not supposed to carry two of the same thing, or they can't join your game or get summoned at all. These are my guesses

i transfered a gold tracer from my 55 to my 75 with a guy who didnt have DLC and he could use it so yes you can sue teh gear without having hte DLC
