ToWP should be allowed but not for Back Stabbing. The cast is slow enough that you can get in a back stab if you want or try to stun lock.
The way ToWP should be used is to allow for slower casting miracles, pyromacies and sorceries to hit their mark. It only last 10. If they cast it too close to you you can always try to hit them with your weapon.
